By accessing or using Smart Agent Guide (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Smart Agent Guide is a software-as-a-service platform for independent real estate agents and brokerages. The Service includes branded agent and brokerage websites, an AI assistant (AImee™) for chat and voice interactions, a customer relationship management (CRM) system, calendar integration, and marketing tools.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when creating and maintaining your account.
Paid plans are billed through our payment processor, Stripe, on a recurring basis. Fees are as described in your order or subscription agreement and are subject to change with notice. Cancellation terms are governed by the plan you have selected; you remain responsible for fees incurred prior to cancellation taking effect.
You agree not to use the Service for any unlawful purpose, and not to scrape, reverse engineer, or attempt to extract the source code of the Service. When using the Service's outreach features (including email, SMS, and voice), you are responsible for complying with applicable law, including the Fair Housing Act, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and Do-Not-Call (DNC) requirements. The Service provides tools to help you communicate with clients; you remain solely responsible for the content and delivery of your communications.
You retain ownership of your contacts, listings, and other content you upload to the Service (“Customer Data”). We process Customer Data solely to provide and support the Service on your behalf.
All content, software, and materials that make up the Service, including the Smart Agent Guide name, AImee™, and related branding, are the property of Smart Agent Guide LLC or its licensors and are protected by applicable intellectual property laws.
Our AI assistant (AImee™) provides general real estate information. AImee does not provide legal, financial, or tax advice. Always consult with qualified professionals for specific guidance.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the fees you paid us in the twelve (12) months preceding the claim.
We may suspend or terminate your access to the Service for violation of these terms or nonpayment. You may cancel your subscription at any time in accordance with your plan terms.
We may update these Terms of Service from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
